Nomi Abadi Breaks NDA Again by Suing Danny Elfman for Defamation

We were really hoping we could retire. We have left this blog alone, even though we had more to share, because we hoped Nomi was done. It seemed that, perhaps, she was ready to move on with her life, and we didn't want to poke the bear. Unfortunately, this is apparently not the case.

Nomi Abadi Went to The Press First (Again):


We previously wrote that we believe Nomi (or her lawyers) went to the press before the July 2023 lawsuit was made publicly available, possibly even before it was filed with the court. At the time, a spokesman for Elfman told Rolling Stone,“while we can’t comment on a lawsuit that we haven’t received, the fact that it has made its way to the media before the defendant further shows that this is another stunt in a years-long campaign to demand money from Mr. Elfman and his family.”


This time, we have no doubt that the press saw the defamation suit prior to its release to the public.


On July 10, at 5:38pm PT, Variety published an article, stating that Nomi Abadi has filed a defamation suit in Los Angeles against Danny Elfman. Within the same hour (exact time unknown), Rolling Stone published a similar article. The case did not appear on the LA Court website until the following day, sometime between 8 am and 12:45 pm PT.

Once it did appear online, the case documents were still inaccessible. The site showed us this message:

Error message that reads "Case 24STCV17141 cannot be found or the security level of this case is too high."

Variety updated their article, in that same window of time, to include a copy of the lawsuit. It seems like they were waiting for it to hit the court website to release it. However, their copy did not include the stamp of the court clerk, meaning they did not receive it from the court website, but likely from Nomi herself.


Around noon on 7/12, one of our team noticed the documents were finally accessible, and we downloaded them. HERE is the folder with all of the documents for the defamation case.

As we can see from the clerk's stamp, the lawsuit was filed with the court at 4:26 pm on 7/10/24. Variety published their article 1 hour and 12 minutes later. We strongly believe Nomi Abadi gave her lawsuit to the press before she filed it with the court.


I will remind the reader that Nomi Abadi is still under the NDA she signed when she accepted the $830K settlement. She is once again, in our opinion, using the legal system and the press to break her NDA.


A recap of Abadi / Elfman court stuff thus far:


7/19/23: Rolling Stone published an article, detailing how Nomi Abadi was suing Danny Elfman for failure to make two payments of a $830K sexual harassment settlement. The article was published within five hours of the filing, and included many, many details that were not in the court documents. We believe that the details of Abadi's original accusations were divulged by Nomi, her lawyers, and/or sources she provided, even while she was under the NDA she signed as a condition of the settlement.


Rolling Stone also published statements from Elfman and his team, refuting the claims made by Abadi. It is these refutations that Abadi is now claiming to be defamation. Statements Elfman never would have made if Abadi had not gone to the press, while under NDA, to smear his name.


9/19/23: Danny's legal team requests that the arbitration clause in the settlement be honored.


11/29/23: Abadi and her team oppose the Motion to Compel Arbitration.


12/6/23: Elfman's team replies.


12/13/23: The Motion to Compel Arbitration is granted. The court agrees with Elfman's lawyers that Abadi did not have the right to go around the arbitration clause and make the entire thing public with a lawsuit.


7/3/24: Abadi's team gives the court an update on arbitration, which was due 7/11/24. In the Declaration, Abadi's team asks for a 120 day continuance, as arbitration has not even been scheduled yet. They provide an email chain, allegedly showing that Elfman's team has been mostly unresponsive in their attempt to initiate scheduling with the arbitrator. We learn that the arbitrator will be the same one they used to reach the 2018 settlement, Hon. Carla Woehrle.


7/10/24 at 4:26 pm: The court clerk accepts the filing of the defamation lawsuit from Abadi.


7/10/24 at 5:38 pm: Variety (and Rolling Stone, in the same hour) publishes an article about a defamation lawsuit Abadi has filed in Los Angeles against Elfman, regarding his refutation of her accusations in the July 2023 Rolling Stone article.


7/11/24: At 8:30 am, lawyers from both sides meet (virtually) to give an update to the court on the arbitration of the 2023 case. A continuance is granted, and they'll check in again on 11/06/2024.


7/11/24: Between 8 am and 12:45 pm, the case shows up on LACourt.org. The documents are not accessible, but Variety updates their article to include a copy of the lawsuit. It does not have the clerk's stamp, meaning they did not get it from the court.


7/12/25 around noon: Our team notices that the documents of the new case are now accessible, and we download them.



Abadi makes new claims in her defamation suit:


We hope to publish a breakdown soon on the new claims that Abadi has presented in her new lawsuit and how they stack up against what she has said in the past.


New claims include:

  • He did touch her after all (she previously said he didn't) by grabbing her wrist to force her hand onto her own genitals.

  • He apologized for his behavior and promised not to do it again.

  • He threatened her if she didn't keep what happened in Paris a secret.

  • He would yell at her and jab a finger in her face.

  • She could smell the semen in the martini glass!

  • He made anti-semitic remarks! (They're both ethnically Jewish, but Variety only mentioned Abadi's Jewish heritage...)
